This contract is simply to ensure that everybody is in agreement regarding the services I will be providing. Please don't hesitate to contact me should there be a problem with the information below.
Contract for servicesThis agreement constitutes an order for photography services, including the taking of pictures as agreed to by both parties--photographer (Lauren Kaufmann) and Kaufmann Photography, both hereinafter known as the photographer, and the client--and the provision to the client of proofs in digital form.
It is understood nonetheless that the photographer will own the copyright to all digital files and images and reserves the right to use them for advertising, display or any other purpose thought proper by the photographer. The client hereby releases the photographer, its legal representatives, assigns, and employees from all claims and liability relating to said photographs.
All proofs will be provided in digital form. Although utmost of care will be taken with digital files, photographer limits any liability for loss, damage, injury, or failure to deliver pictures for any reason, to the return of payments made. The limit of liability for a partial loss of digital files shall be a prorated amount of the images lost based on the percentage of total number of digital files.
In the unlikely event that the photographer is injured or becomes too ill to photograph the event, photographer will make every effort to secure a suitable replacement photographer. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package.
On signing of this agreement by both parties hereto, the photographer will reserve the date and times agreed upon and will not make another reservation for the specific date and time frame. For this reason, all retainers are non-refundable even if the date is changed or if the session becomes canceled for any reason.
Additional hours of coverage can be added for $250 per hour. Time is of the essence for receipt of payment. No photography will take place and no rights are granted until timely payment is made in full.
No other photographers (professional or amateur) are allowed to photograph the session without the photographer's permission. The client hereby releases, discharges and agrees to save harmless the photographer, its heirs, legal representatives, assigns, employees or any persons or corporations acting under permission or authority from the photographer from and against any liability as a result of any distortion, blurring or alteration, optical illusion or use in composite form, either intentionally or otherwise, that may occur or be produced in the taking, processing or reproduction of the photographs.
All disputes arising under this agreement shall be resolved through mediation. If mediation is unsuccessful, the dispute will be submitted to binding arbitration.
The client understands that the photographer will likely design their initial album design (if album has been requested) with more spreads than they ordered. This is done as a service to the client but the client is in no way obligated to purchase the additional spreads.
If the client purchases a product from the session, the client is responsible for finalizing their album design no later than 6 months after their session. After 6 months, if the album design is not finalized by the client, the base price of the album will increase by $500. If after one year the album design is not finalized, the base price of the album will increase by another $500.
There are no returns or refunds for products purchased. I, the undersigned client, hereby warrant that I am competent to contract in my own name. I confirm that I have read the herein agreement prior to its execution and I am fully familiar with the contents thereof. This agreement shall be binding upon me and my heirs, legal representatives and assigns.
